Terms of Service

Thanks for using Votiez. We built it to help founders and indie makers collect feedback, prioritize what to build, and ship in public. These Terms of Service ("Terms") are the agreement between you and us. We've tried to write them in plain English so you actually know what you're agreeing to.

When we say "Votiez", "we", "our", or "us" in this document, we are referring to Votiez, a service operated by an independent developer based in Vietnam. When we say "Service", we mean the Votiez website at votiez.com, the project subdomains we host on your behalf, and the underlying application. When we say "you" or "your", we mean the person or organization with a Votiez account.

We may update these Terms from time to time. When we make a meaningful change, we'll refresh the "Last updated" date at the top and, where appropriate, notify account holders by email. Continued use of the Service after a change means you accept the updated Terms.

These Terms contain a limitation of our liability. Please read them carefully.

Account terms

  1. You are responsible for keeping your account credentials secure and for everything that happens under your account, including the content and activity of any teammates you invite.
  2. You must be at least 13 years old (or the minimum age required in your country) to use Votiez.
  3. You may not use Votiez to host or distribute illegal content, harassment, spam, malware, sexually explicit material involving minors, or anything that infringes someone else's rights. We may remove content or suspend accounts that violate this rule, with or without notice.
  4. You must be a human. Accounts registered by bots or automated methods are not permitted, except for documented programmatic access to your own data.

Payment, refunds, and plan changes

  1. Votiez offers a free plan. You can use it without giving us a credit card.
  2. Paid plans are billed in advance through our payment processor, Polar. Your card details are handled by Polar; we never see or store them ourselves. If a payment fails, your account may be downgraded to the free plan until payment is restored.
  3. When you upgrade from free to paid, you are charged immediately and a new billing cycle starts that day. Downgrades take effect at the end of your current billing cycle.
  4. All prices are exclusive of any applicable taxes. Where we are required to collect them, we will; otherwise you are responsible for tax compliance in your own jurisdiction.
  5. If you believe you were charged in error, contact us at support@votiez.com within 30 days and we'll look into it. Beyond 30 days we may not be able to issue a refund, but we'll always try to do the right thing.
  6. Downgrading your plan may cause loss of access to features, content, or quotas you used at the higher tier. If your account exceeds the new plan's limits, parts of it may be locked until you bring it back into compliance or upgrade again.

Cancellation and termination

  1. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current paid period; you will not be charged again.
  2. You can also delete your account entirely. When you do, your content and personal data will be removed from our active systems within 60 days, and from backups within an additional 30 days. See our Privacy Policy for details.
  3. We reserve the right to suspend or terminate any account that violates these Terms, abuses the Service, or threatens the safety of our infrastructure or other users. Where reasonable, we'll warn you first; in cases involving abuse, illegal activity, or imminent harm, we may act immediately.
  4. Abuse, threats, or harassment directed at the operator or anyone working on Votiez will result in immediate termination.

Modifications to the Service and prices

  1. We may add, change, or remove features at any time. We do our best to give notice before removing anything material, but reserve the right to do so.
  2. We may change pricing for new customers at any time. For existing paid customers, we will give at least 30 days' notice by email before a price change takes effect.

Uptime, security, and privacy

  1. Your use of Votiez is at your sole risk. We provide it on an "as is" and "as available" basis. We do not currently offer a formal SLA. We take uptime seriously but cannot guarantee uninterrupted service.
  2. We take reasonable measures to protect your data, including encryption in transit, encryption at rest for our database, and hosting on reputable infrastructure providers. No system is perfectly secure, however, and you accept the residual risk inherent in using online services.
  3. When you use Votiez, you entrust us with your data. We process it as described in our Privacy Policy and for no other purpose. We do not sell your data. A human may access your content only:
    • To help you with a support request you sent us;
    • To diagnose an automated process that errored partway through, and only when strictly necessary;
    • To investigate suspected abuse or a security incident affecting the Service;
    • When compelled to by valid legal process under applicable law.
  4. We use third-party sub-processors (such as Clerk for authentication, Convex for the database, Polar for billing, Resend for email, and Railway for hosting) to run the Service. The current list and what each one does is in our Privacy Policy.
  5. If the EU or UK General Data Protection Regulation applies to your use of Votiez, you may request a Data Processing Addendum by emailing privacy@votiez.com.

Your content

  1. You retain ownership of everything you submit to Votiez — feedback posts, comments, project content, logos, and so on. We claim no ownership over your content.
  2. You grant us a limited, non-exclusive license to host, copy, transmit, and display your content solely to operate the Service — for example, rendering a public feedback board you've chosen to publish.
  3. You are responsible for ensuring you have the right to post the content you submit, and that it does not violate someone else's copyright, trademark, privacy, or other rights.
  4. We do not pre-screen content. We reserve the right (but not the obligation) to refuse or remove any content that we believe violates these Terms or applicable law.
  5. Votiez itself — its code, design, brand, and trademarks — belongs to us. You don't get any rights to it beyond what's needed to use the Service.

Features and bugs

We design Votiez carefully and test our features before shipping, but software always has bugs. We track issues that get reported, prioritize the important ones (especially anything affecting security, privacy, or billing), and fix what we can. We do not guarantee that the Service will meet your specific requirements or be error-free.

Liability

You expressly understand and agree that Votiez and its operator shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use of or inability to use the Service; (ii) the cost of procurement of substitute goods or services; (iii) unauthorized access to or alteration of your data; (iv) statements or conduct of any third party on the Service; or (v) any other matter relating to these Terms or the Service.

In plain English: choosing to use Votiez means you're trusting us to do our best. If something goes wrong, we'll work to make it right, but we can't be on the hook for consequential damages. Where the law in your jurisdiction does not allow some of the limitations above, our liability will be limited to the greatest extent permitted.

Governing law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the competent courts of Vietnam, except where mandatory consumer protection laws in your country of residence grant you additional rights.
